1. Introduction
Welcome to mybnb.net.au.
These Terms and Conditions (“Terms”) govern your access to and use of the mybnb.net.au website, mobile applications (if available), and any related services provided through the platform (collectively, the Platform).
By creating an account, browsing listings, making an enquiry, listing accommodation, making or accepting a booking, or otherwise using the Platform, you acknowledge that you have read, understood and agree to be legally bound by these Terms.
If you do not agree to these Terms, you must not use the Platform.
mybnb.net.au operates an online marketplace that connects people seeking accommodation (“Guests”) with people offering accommodation (“Hosts”).
Unless expressly stated otherwise, mybnb.net.au is not the owner, operator, manager or provider of accommodation listed on the Platform. Accommodation is offered by independent Hosts who are solely responsible for their properties, listings and the services they provide.
Bookings made through the Platform create a contractual relationship directly between the Guest and the Host.
mybnb.net.au is not a party to that accommodation agreement except to the extent necessary to facilitate bookings, payments and other services provided through the Platform.
2. Definitions
In these Terms, unless the context otherwise requires:
Account means a registered user account on the Platform.
Booking means a reservation for accommodation confirmed through the Platform.
Booking Confirmation means confirmation issued by mybnb.net.au that a booking has been successfully accepted and payment has been authorised or received.
Guest means any individual who searches for, enquires about, books or stays at accommodation listed on the Platform.
Host means any individual or business that lists accommodation on the Platform.
Listing means accommodation advertised by a Host on the Platform.
Platform means the mybnb.net.au website, any associated applications, systems, software and services.
Property means accommodation listed by a Host.
Service Fee means any fee charged by mybnb.net.au for use of the Platform.
User means any person who accesses or uses the Platform, including Hosts and Guests.
We, our, us, and mybnb.net.au mean the business trading under the registered Australian Business Number (ABN) 95 458 760 201, operating the Platform.
3. About mybnb.net.au
mybnb.net.au provides an online marketplace that enables Hosts to advertise accommodation and Guests to discover, enquire about and book accommodation.
Our role includes facilitating:
- property listings;
- property search;
- guest enquiries;
- booking requests;
- payment processing;
- communication tools;
- reviews;
- dispute assistance where appropriate; and
- other services offered through the Platform.
Unless expressly stated otherwise, mybnb.net.au does not own, inspect, certify or endorse accommodation listed by Hosts.
We do not guarantee:
- the quality of accommodation;
- the suitability of accommodation for a Guest’s needs;
- the conduct of any Host or Guest;
- uninterrupted availability of the Platform; or
- that every listing will be accurate or free from error.
Hosts remain solely responsible for the accommodation and services they provide.
Guests remain responsible for selecting accommodation that meets their own needs.
4. Acceptance of these Terms
You agree to these Terms by:
- creating an Account;
- browsing Listings;
- making or receiving enquiries;
- listing accommodation;
- submitting or accepting a Booking;
- making payments through the Platform; or
- otherwise using the Platform.
If you use the Platform on behalf of another person, company or organisation, you warrant that you have authority to bind that person or entity to these Terms.
5. Eligibility
To create an Account or make a Booking, you must:
- be at least eighteen (18) years of age;
- have the legal capacity to enter into binding contracts;
- provide accurate and complete information;
- comply with all applicable Australian laws; and
- not have previously been suspended or permanently removed from the Platform.
Bookings for minors may only be made by an adult who accepts full responsibility for all guests included in the booking.
Hosts may specify additional age requirements where permitted by law and clearly disclosed in the Listing.
6. User Accounts
You must provide accurate, current and complete information when creating an Account.
You are responsible for maintaining the confidentiality of your login credentials.
You must not:
- share your Account with another person;
- create multiple Accounts to avoid restrictions;
- impersonate another individual;
- provide false identity information;
- create fake reviews or Listings.
You are responsible for all activity that occurs under your Account until you notify us of unauthorised access.
We reserve the right to suspend, restrict or permanently close Accounts where we reasonably believe these Terms have been breached or the Platform, its users or reputation may be placed at risk.
7. Identity Verification
mybnb.net.au may request identity verification at any time.
Verification may include requesting:
- government-issued identification;
- proof of address;
- payment verification;
- business registration documents;
- photographs;
- or any other information reasonably required to verify identity or reduce fraud.
Completion of identity verification does not constitute an endorsement, guarantee or certification by mybnb.net.au.
We may refuse, suspend or terminate Accounts where verification cannot be satisfactorily completed.
8. Changes to these Terms
We may update these Terms from time to time to reflect changes in our services, legal obligations, technology or business practices.
Where changes are material, we will take reasonable steps to notify registered users before the changes take effect.
By continuing to use the Platform after revised Terms become effective, you agree to be bound by the updated Terms.
If you do not agree to the revised Terms, you must stop using the Platform and close your Account.
